Tirelibrary Subscription License Agreement

Effective Date: The effective date of this Agreement is the date on which you accept it online and enter into a subscription via the Tirelibrary application.

This Subscription License Agreement ("Agreement") governs your access to and use of the Tirelibrary application and services ("Tirelibrary"), provided by Tireweb Connections USA, Inc, a Delaware corporation ("Licensor", "we", "us", or "our"). By signing up for or accessing Tirelibrary, you ("you", "your", or "Licensee") agree to be bound by this Agreement.

1. Subscription Terms

1.1 Free Trial

Each user is entitled to a one-time, 7-day free trial. Billing will automatically begin at the end of the trial period unless you cancel through the "Manage Subscription" section of the application before the trial ends.

1.2 Subscription Billing

Tirelibrary is offered on a monthly subscription basis. Subscriptions renew automatically unless cancelled. You may cancel at any time via the application interface. No refunds are provided for unused subscription periods.

1.3 Access Limitations

Your subscription grants access to one user per account/email address. Sharing accounts or login credentials is strictly prohibited. For multi-user or enterprise access, a separate license agreement is required.

2. License Grant and Restrictions

2.1 Limited License

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Tirelibrary solely for your internal business or personal purposes.

2.2 Prohibited Uses

Copy, reproduce, download, export, or store Tirelibrary data or content;
Use Tirelibrary content or data on any public or commercial website or platform, including B2B or B2C e-commerce websites;
Scrape, crawl, harvest, or index Tirelibrary content using automated tools;
Use bots, scripts, or other mechanisms to query or extract data from the application;
Resell, sublicense, or commercially exploit any part of Tirelibrary or its contents.

We may immediately suspend or terminate your access for breach of this Section.

3. Data and Accuracy Disclaimer

3.1 Third-Party Information

Tirelibrary includes tire specifications, images, and data from third-party sources, including tire manufacturers. Such information may include third-party trademarks, which remain the property of their respective owners.

3.2 Accuracy and Suitability

While we endeavor to maintain accurate information, Tirelibrary is provided "as is" and we do not guarantee the completeness, accuracy, or suitability of any content. You are responsible for verifying all information, including consulting your vehicle placard or manufacturer recommendations.

3.3 No Liability

To the fullest extent permitted by law, we disclaim all liability for reliance on Tirelibrary content. Use of the data is at your own risk and you should not rely solely on it to make purchasing or safety-related decisions.

4. Intellectual Property

4.1 Ownership

All rights, title, and interest in and to Tirelibrary (including software, databases, text, images, and metadata) are owned by Tireweb Connections USA, Inc or its licensors.

4.2 Reservation of Rights

You acknowledge and agree that, except as expressly granted herein, no license or ownership right is transferred to you. You may not challenge our rights in Tirelibrary or its data.

5. Termination

5.1 Cancellation by You

You may cancel your subscription at any time using the “Manage Subscription” section. Access will continue until the end of your current billing cycle.

5.2 Termination by Us

We may suspend or terminate your access without notice if you breach this Agreement, including any prohibited use of the service.

6. Support

We provide email support during standard U.S. business hours. Support requests can be submitted through https://tireweb.zendesk.com.

7. Limitation of Liability

7.1 No Warranties

TIRELIBRARY IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

7.2 No Liability for Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3 Liability Cap

OUR MAXIMUM LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. General

8.1 Eligibility

You must be at least 18 years old to subscribe to Tirelibrary.

8.2 Export Control

You agree to comply with all applicable export control laws and regulations.

8.3 Governing Law

This Agreement shall be governed by the laws of the State of Delaware. Any disputes shall be resolved in the state or federal courts located in Delaware.

8.4 Modifications

We may update this Agreement from time to time. Continued use after changes are posted constitutes your acceptance of the updated terms.

8.5 Entire Agreement

This Agreement constitutes the entire agreement between you and us concerning your use of Tirelibrary and supersedes any prior agreements or understandings.

8.6 Agreement Updates

We may update this Agreement from time to time. Continued use of Tirelibrary after any changes become effective constitutes your acceptance of the new terms. The current version of this Agreement is always available via the Terms and Conditions link on our Tirelibrary application.
